MP Dmytro Kolesnikov, on behalf of the OPPOSITION BLOC parliamentary faction, arrived at the Starobilsk District Court with applications from MPs from the OPPOSITION BLOC about taking on bail the MP of several convocations Oleksandr Yefremov. He has been detained for more than 2.5 years in the pre-trial detention centre without judicial review of the case in essence, court decision and proven guilt.
In their applications to the Starobilsk Court, MPs emphasize that the investigation into the criminal proceedings opened in December 2016 against Oleksandr Yefremov has not yet been completed, which causes concern. The MPs give personal guarantees that Oleksandr Yefremov will be able to properly fulfill his procedural obligations in the framework of the trial without detention; they undertake to bring him to the pre-trial investigation authorities and the court upon request, therefore, they appealed to the court with a petition to take him on bail.
Recall, among the criminal cases initiated against Oleksandr Yefremov in 2014-2016, two (for inciting ethnic hatred and abuse of power) were closed by the court due to the lack of corpus delicti. According to fabricated in 2016 charges of encroachment on the territorial integrity of the state and treason, because of which, in violation of the provisions of the Criminal Procedure Code, Oleksandr Yefremov is being prolonged with a preventive measure and kept in custody, so far, the prosecutor’s office has also failed to gather and present evidence of guilt, despite two years of investigations and a huge number of prosecution witnesses.
Oleksandr Yefremov without proof is also accused of committing crimes under Part 3. 3. 27, Art. 341, h. 5 Art. 27, Art. 341, Part 1, Art. 258 ca. 3, Part 1 of Art. 111 of the Criminal Code of Ukraine. On January 21, 2019, the Starobilsk Court has already rejected a similar petition from opposition deputies.MPs from the OPPOSITION BLOC express their support to Oleksandr Yefremov and consider the unjustified extension of the preventive measure in the form of detention in custody to be torture and violation of his procedural rights, and the process against him – politically motivated.
